A demandant is another term for a plaintiff. A demandant is one who makes a claim or demand. This is an archaic term that was first used in the 15th century.

Legal Vocabulary: Case Law vs. Statutory Law

Case law also known as common law is defined as follows: “Law based upon or settled by decided cases; decisions handed down by judges and having the effect of law.”

Statutory law is defined as: “The law as set forth in statutes. (A legislative enactment duly sanctioned and authenticated by constitutional rule; act of Parliament, Congress, etc.; also, any authoritatively declared rule, ordinance, decree, or law.)”

Legal Vocabulary: Avulsion

Avulsion is defined as: “The immediate and noticeable addition to land caused by its removal from the property of another, by a sudden change in a water bed or in the course of a stream.

When a stream that is a boundary suddenly abandons its bed and seeks a new bed, the boundary line does not change. It remains in the center of the original bed even if water no longer flows through it. This is known as the rule of avulsion.” [SOURCE: The Free Dictionary]

Assumpsit as the following definitions: “(1) A promise by which someone assumes or undertakes an obligation to another person. (2) An agreement or promise made orally or in writing not under seal; a contract. (3) A legal action seeking compensation for the nonperformance of a contract that was not officially approved or recorded. (4) An actionable promise. (5) A legal action for a breach of agreement.”
